Felicity is highly sought after for her expertise in technology cases, all areas of Intellectual Property, trade practices and related commercial disputes. With over 20 years’ experience, Felicity has significant expertise across a broad range of Intellectual Property law, her practice commonly involving cases with significant technical content.

Felicity’s expertise extends to corporate and commercial law and to consumer protection legislation. She regularly advises clients in relation to a broad range of contractual disputes, including franchising disputes. Felicity has substantial experience in large-scale litigation, regularly appearing with a leader, and as sole counsel. In addition to appearing in Melbourne, Felicity has appeared in cases in Sydney, Adelaide and Perth.

Areas of Practice

Intellectual Property – All areas of Intellectual Property including trade mark oppositions, non use applications, trade mark infringement and revocation proceedings, patent infringement and revocation proceedings, advice in relation to licensing and commercialization of IP, infringement of copyright and designs, passing off and misleading or deceptive conduct claims and breach of confidential information cases.

Competition and Consumer Law – Consumer Law disputes under Schedule 2 of the Australian Consumer Law, drafting trade practices and consumer protection manuals and presenting at seminars for national corporations, Statutory Authorities and Government Instrumentalities.

IT and Technology - Major IT commercial contracts and disputes from IT systems applications contracts to multi-million dollar outsourcing arrangements and domain name disputes.

Commercial – Major commercial contract disputes including franchise disputes and interlocutory applications in the Federal Court.

Prior to coming to the Bar, Felicity was a partner at Phillips Fox (now DLA Phillips Fox) in the Intellectual Property, Trade Practices and Information Technology Group. She has also practised in London at Herbert Smith. Felicity was admitted to practice in Victoria in 1981 having completed a Bachelor of Arts and a Bachelor of Laws from the University of Melbourne.
