Toby Borgeest comes to the Bar following 18 years as a commercial and civil litigation lawyer in a large national practice.
In recent years, Toby has specialised in large commercial litigation projects, with a focus on shareholder class actions, professional negligence claims against lawyers, accountants, financial advisers and auditors, private company shareholder disputes, consumer protection and insolvency.
Industrial and employment law
Toby has a particular expertise in all aspects of workplace relations law, including industrial relations disputes, industrial instrument enforcement, employment contract claims, statutory protections including dismissal and discrimination matters, disputes arising from union rules and elections, and regulators' inquiries and prosecutions.
In his early years of practice, Toby conducted a high volume unfair dismissal and employment law claims practice in the industrial tribunals, Federal and Magistrates' courts. Since that time, Toby has acted for most Victorian unions as well as union clients in NSW, Queensland and Western Australia. Toby has conducted employment contract claims in the Supreme Court of Victoria and superior courts of other jurisdictions.
Toby obtained accreditation as a specialist in workplace relations in 2004, under the specialist accreditation scheme administered by the Law Institute of Victoria.
Toby practised at Slater and Gordon from his articles year in 1998, until joining the Bar in 2015. He became a partner of that firm in 2004. Between 1998 and 2004 he worked in that firm's Industrial and Employment Law practice in Melbourne, before moving to Perth and leading the firm's Industrial and Employment Law practice in that jurisdiction. Toby returned to Melbourne in 2009 and practised as a Principal in the Commercial and Projects Litigation department.
